DEFINITIONS
The Company means plastichobbys.com and its retail outlet Plastic Hobbys. The Purchaser means any person, firm, company or organisation who is trading with the Company. The term goods shall mean the article(s) which the Purchaser buys or agrees to buy from the Company. Working day means a day which is not a Saturday, Sunday or Bank/Public holiday in England or Wales. A Calendar day means a day which is a Monday, Tuesday, Wednesday, Thursday, Friday, Saturday, Sunday or Bank/Public Holiday in England or Wales.
Acceptance: These terms and conditions apply to the use of this website. By accessing this website and/or placing an order, you agree to be bound by the terms and conditions set out below. All orders are accepted subject to these Terms and Conditions unless otherwise specified and agreed in writing by the Company. Product Description & Availability; We will try to ensure that all details on the site are accurate and we aim to keep the website as up-to-date as possible. We do not knowingly misrepresent items for sale in any way. Packaging may vary from that shown and all weights and dimensions (if given) are approximate only and solely for the purpose of the systems weight category calculations and not to define actual weights and measures. All Items are subject to availability. If, during processing, we discover that we cannot complete the order for any unforeseen reason, we will cancel the order and refund if necessary. (This, for example, may apply to a stock shortage, inability to obtain payment, a product fault or a product description fault). If purchasing multiple items and one or more of the items are out of stock, we may send what we have and send the balance as soon as possible. We try to ensure all items are in stock however, all products listed on this selling platform are also available for sale in our retail outlet, and from time to time re-stock may be in progress when orders are placed. Here we will process your order(s) as soon as replacement stock is delivered.
Price Policy: Website: All prices are subject to change without prior notice. All prices are displayed inclusive of VAT and are payable in British Pounds Sterling (£). If we identify a price error in any order we reserve the right to cancel the order and withdraw the product from sale. The sale contract between the Company and the Purchaser is only formed once we have dispatched the order. Any prior confirmation emails or communication is simply acknowledgement of the order. The Company reserves the right, on or at any time after the acceptance of an order, to charge the Purchaser the relevant delivery charge, or any outstanding proportion thereof, prevailing at the time of despatch of the goods, where the purchaser has not paid the relevant delivery charge for that order. All prices are inclusive of VAT, at the applicable UK rate. The Company reserves the right to increase prices if the standard VAT rate should ever increase. Note: These prices are ONLY available on this website, and as such there is NO obligation for plastichobbys.com to match anywhere else, should we be asked.
Orders and Delivery: Most of our orders are advertised with a relevant postage charge. These orders will be sent by My Hermes, Royal Mail or other such delivery partner(s) depending upon the Purchasers choice of postal option. Information about these services can be found on their respective company websites.
We endeavour to process /dispatch order(s) with 3 working days of any cleared payment. Delivery shall be made to the address specified by the Purchaser at the time of ordering. Please note that when the product is with the postal services or courier we have no control over the package - it is in their hands to deliver within the timescales they offer. The Company reserves the right not to deliver orders if the Company believes the address is not secure e.g. to a communal postal address or P.O. Box. A secure place of delivery and/ or alternative address must be advised by the Purchaser to ensure goods are delivered to the timescales of the postal service(s) and/ or to the postal option chosen by the Purchaser. The Company reserves the right, where payment for goods ordered has been made by cheque, to hold any such order until the Company has received confirmation that the cheque has been cleared and the funds paid to the Company, and at its discretion despatch the order only after such confirmation, which can take up to 10 working days, has been received. If the goods are ordered for a specific date, we recommend ordering well in advance to avoid any disappointment. During the Christmas period we may be very busy, so it may take longer for the items to be sent from our premises.
Payment: Payment may be made by any of the methods indicated on the website. Goods will not be shipped until full payment has been received. Payment is automatically authorised online and your credit/debit card will be charged when the order is accepted. We do NOT take a card payment over the phone. 'To comply with the Payment Card Industry Data Security Standard, personal/payment details are NOT retained. For pre-order items, your credit/debit card will be charged at the time when your order is placed. Your product will be dispatched as soon as it is an available stock item. The Company reserves the right to charge an administration fee, details of which are available upon request, and which may be varied from time to time, for processing dishonoured cheque and/or credit card payments, and such fee will be charged to the Purchaser together with any collection costs/court costs/legal fees incurred in obtaining payment.
Ownership of Goods: Ownership and title of any goods supplied remains with the Company until such time as the Company has received payment in cleared funds from the Purchaser of all sums of money outstanding.
Claims, Shortages, Damaged or Defective Goods If, in the unlikely event that your goods arrive in a damaged condition or are defective, you must inform us as soon as is practically possible, and in any event no later than 7 calendar days after discovery. Failure to do so shall deem that you have accepted the goods. The goods must be unmodified, have been properly used under normal conditions and have been properly stored, installed and maintained. The goods or parts thereof should be returned to us in their original packaging together with supporting documentation, giving the invoice number and the nature of the defect or shortage. For information on our returns policy please see our returns page or contact us direct on the number(s) provided. If for any reason a replacement is not available for a damaged or defective item, we will refund the value of the returned goods by the original payment method. Although every effort will be made by the Company to rectify shortage(s) or damaged goods we do not accept any responsibility for consequential loss of profit. Notwithstanding any other provision contained in these Terms and Conditions the Company shall have no liability whatsoever whether in contract, tort (including negligence) or otherwise for any incidental, special, indirect or consequential loss or damage including but not limited to loss of income, loss of profits or loss of opportunity, arising out of or in connection with the performance of its obligations under these Terms and Conditions, including such damages as may be reasonably foreseeable at the date hereof.
Returns and Refunds (Other): If not fully satisfied with your item within 14 days you may return it (Refunds only accepted if the item is faulty). You are requested to keep packing & delivery notes, return them with the item intact. Genuinely faulty goods will be replaced/ refunded, but we must be advised within 3 days of receipt. Perfect items can be exchanged within 14 days, with postage costs paid by Purchaser (returned unopened and/or unused). Goods returned for refund, exchange or credit must be received by the Company in perfect, unused saleable condition and in their original, undamaged packaging and in the original quantity as specified in/on the order, within 14 days of receipt. The Company will consider the overall condition of the goods being returned when making a refund and reserves the right to withhold a percentage of the refund value of returned goods if they are not in suitable condition for resale at their original catalogue price. The Company will not be liable for any carriage or costs incurred in returning goods unless they are defective or have been sent in error. If the item is found to be faulty, the Company shall refund a MAXIMUM of £2.60 for a single item (<1.kg) and £4.30 UK for multiple items (1k > 2kg) 2nd Class return postage costs only. Overseas costs shall be actual cost of 2ndClass Only. All other costs shall be the responsibility of the Purchaser. No exchange or refund will be given by the Company for any item after a period of 30 Calendar days
Cancellation by us: We reserve the right to cancel the order if:
- We cannot obtain payment;
- We have insufficient stock to deliver the goods you have ordered;
- We do not or cannot deliver to your area or country;
- A product, price or description fault has been identified.
- A product, recall, has been identified.
- Other issues which may arise from time to time
If we do cancel your order we will notify you by email and refund all costs as soon as possible.
Your Statutory Rights are not affected by these Conditions
Suitability: The Purchaser shall be responsible for ensuring products are suitable for the purpose or use intended. No liability is accepted for any loss or damage, however caused, resulting from the use of any products purchased from this website, whether for injury, profit or date loss. Every reasonable care is taken to ensure that products are suitable for the use intended and described accordingly.

Customs: When ordering goods from plastichobbys.com for delivery outside the United Kingdom you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance shall be borne by you; the Purchaser, as we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from plastichobbys.com, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. We would like our international customers to be aware that cross-border deliveries are, or may be, subject to opening and inspection by customs authorities.
Prohibited Goods – Shipping - Owing to the Hazardous Goods Regulations, items such as Aerosols, Paints, Solvents, Adhesives etc, may be restricted to mainland UK addresses only. Such items have been identified by the Company and clearly marked in the website with sufficient warning. The Company may choose to refund the Customer if any particular item(s) purchased fall into the ‘Restricted’ or the ‘Prohibited’ Goods categories listed by our respective carrier/ courier. Non-UK/ International Customers will receive a REFUND in full if the items purchased on, or through, the website cannot be posted to the country chosen by the Customer.

UK VAT: The applicable rate of UK Value Added Tax (VAT) is included in all items listed on this selling platform. VAT registration details are provided on individual invoices. Purchasers placing orders from non-European Union destinations receive a VAT discount upon ‘check out’. This discount applies only to goods and not to the carriage/ postal costs.
Note: Should VAT increase between time of order and time of debit/dispatch, example a pre order item, then the higher VAT amount will be applied to your order, this will not affect non-VAT sales as only the net price is paid, should any import duty become payable on receipt of your order then it is the purchaser/ customers responsibility to pay to any local import duty to the relevant authority. Some goods may be vat exempt (such as catalogues, publications etc) and so will not receive this discount.
General: Any information or data supplied in leaflets, inserts or helpful hint sheets is meant as a guide only. Catalogues are supplied from specific manufacturers and are also meant as a guide to their specific products and their use.
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.
Governing Law: The Governing Law shall be that of England and Wales.
